Construction Disputes

We handle a variety of different kinds of construction disputes, including architectural control committee/homeowner’s association disputes; representing developers; representing builders; representing buyers; construction defect insurance claims; misrepresentations in the sale of a home; elimination of liens; temporary restraining orders and injunctions; and mediation, litigation and arbitration over construction contract breaches.

Homeowner's Association Matters

We draft and file deed restrictions for developers; create and represent homeowners’ associations as outside general counsel, represent associations and property owners on deed restriction and architectural control committee issues; advise boards of directors; handle community elections disputes; consult HOAs related to officer and director law and litigation, prepare organization documents and secretary of state filings; work with HOAs on insurance claims; prepare meeting minutes and consult with HOAs about record keeping and record requests; and mediate, litigate and arbitrate a variety of owner/developer/association disputes.

Land Use/Deeds/Easements

We represent developers, sellers, buyers, grantors and grantees in a variety of land use issues, including negotiation of deals; preparation of real estate filings; creation and abandonment of a variety of easements; and mediation, litigation and arbitration.

Leases

We represent landlords and tenants in negotiating leases; resolving lease disputes; and handling and opposing evictions.

Ownership Entities

We advise clients on formation and structuring of various types of real estate ownership entities for tax planning and liability concerns, including corporations, limited partnerships, and limited liability companies.

Purchase/Sale

We represent clients in all stages of the purchase and sale of real estate.

Real Estate Agreements

We help clients with negotiation and drafting of various types of real estate agreements; options; earnest money contracts; sale and purchase documents; and licenses.

Real Estate Litigation

We represent clients in real estate law suits, including interpretation of deeds; breach of sale/purchase agreements; premises liability; adverse possession; foreclosure; establishment or abandonment of easements; drainage, water and riparian rights; nuisance; trespass; clouded title, and other issues.
